Agreement

By accessing or using HYP Yoga, you agree to these Terms of Service and our Privacy Policy. If you do not agree, please do not use the site. These terms apply to all visitors, registered users, and subscribers.

HYP Yoga is operated by Joshua Judd as a sole proprietorship under the name HYP Yoga.

Eligibility

You must be at least 16 years old (or the minimum age required by applicable law in your jurisdiction) to create an account or use the interactive features of HYP Yoga. The texts themselves are freely accessible to all visitors regardless of age.

Your Account

You are responsible for maintaining the security of your account credentials and for all activity that occurs under your account. Use a strong, unique password and do not share your login details. If you believe your account has been compromised, contact us immediately at namaste@hyp.yoga.

We reserve the right to suspend or terminate accounts that violate these terms. See the Termination section below for details.

The Texts

The classical yoga texts presented on HYP Yoga — including the Hatha Yoga Pradipika and Patanjali's Yoga Sutras — are in the public domain. The specific translations, formatting, and presentation on HYP Yoga are part of the platform's original work. You are free to read, study, and quote from these texts. You may not scrape, bulk-copy, or systematically reproduce the site's presentation of these texts for commercial purposes.

Your Content

Ownership: You retain ownership of the content you create on HYP Yoga, including journal entries, Voice Sparks, and profile information.

License: By posting public content on HYP Yoga (such as public journal entries or your profile), you grant HYP Yoga a non-exclusive, royalty-free license to display that content on the platform as part of its normal operation. This license exists solely so the site can function — for example, showing your public journal entries to other users. You can revoke this license at any time by making your content private or deleting it.

Export: You may export your journal entries and Sparkmarks at any time using the built-in export tools.

Conduct: You agree not to post content that is illegal, harassing, hateful, spam, or that infringes on the rights of others. HYP Yoga is a space for the study of yoga philosophy and practice. Content should reflect that spirit. We reserve the right to remove content that violates these standards.

AI Companions

SwamiGPT and DharmaGPT are AI-powered study companions. They are tools for exploration and reflection — not authoritative sources. Their responses are generated by large language models (OpenAI and Anthropic) and may contain inaccuracies. Always cross-reference important claims with the source texts or qualified teachers.

AI Companion usage is subject to the rate limits and feature availability of your subscription tier. We may adjust these limits as the platform evolves.

Subscriptions

Paid subscriptions (Aspirant and Teacher tiers) are billed through Memberful and processed by Stripe. By subscribing, you agree to Memberful's terms and Stripe's payment terms in addition to these terms.

Subscriptions renew automatically at the end of each billing period unless you cancel. You can manage or cancel your subscription at any time through your Memberful account. Refund requests are handled on a case-by-case basis — contact us at namaste@hyp.yoga.

Termination

By you: You may delete your account at any time from your account settings. Upon deletion, your private content will be removed. Public journal entries you have shared may remain visible in anonymized form unless you make them private or delete them before closing your account. You can also contact us at namaste@hyp.yoga for assistance.

By us: We may suspend or terminate your account, without prior notice, if you violate these terms. This includes but is not limited to: posting harassing, hateful, or illegal content; spamming other practitioners or abusing the journal, profile, or messaging features; attempting to scrape, reverse-engineer, or exploit the platform; circumventing subscription tier limits or rate limits; impersonating another person or misrepresenting your identity; or any other conduct we reasonably determine is harmful to the community or the platform.

If your account is terminated for a terms violation, any active paid subscription will be canceled and you will not be entitled to a refund for the remaining billing period. You may still contact us to request an export of your personal data.

Intellectual Property

The HYP Yoga platform — including its design, code, features, branding, and original content — is the intellectual property of HYP Yoga. "Sparkmarks," "Voice Sparks," "Quick Terms," "Hero Images," "AI Sparks," "Link AI Sparks," "SwamiGPT," and "DharmaGPT" are original feature names of the platform. You may not copy, reproduce, or create derivative works of the platform itself without permission.

Disclaimers

HYP Yoga is provided "as is" without warranties of any kind, express or implied. We do our best to keep the platform accurate, available, and functioning well, but we do not guarantee uninterrupted service, error-free content, or that the AI Companions will always provide accurate information.

The content on HYP Yoga is for educational and study purposes. It is not a substitute for professional medical advice, mental health services, or instruction from a qualified yoga teacher. Practice safely and consult professionals as needed.

Limitation of Liability

To the fullest extent permitted by law, HYP Yoga and its operator shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the platform, including but not limited to loss of data, loss of profits, or personal injury resulting from yoga practice inspired by content on the site.

Changes to These Terms

We may update these terms from time to time. Changes will be posted on this page with an updated effective date. Continued use of HYP Yoga after changes are posted constitutes your acceptance of the revised terms. For significant changes, we will make reasonable efforts to notify registered users by email.

Governing Law

These terms are governed by the laws of the State of Colorado, United States, without regard to conflict of law principles. Any disputes arising from these terms or your use of HYP Yoga shall be resolved in the courts of the State of Colorado.
